Sex with animals and Islam Part 3/3

Part 3/3 Allegations and Controversies

Claim: No Prohibition in Quran

Some critics argue that Quran doesn’t prohibit Bestiality directly. Hence Quran allows bestiality. Although it is true that Quran doesn’t mention Bestiality directly yet Quran has given the limit of lawful intercourse. The reason quran didn’t mention bestiality is that Quran is very concise and brief yet very clear. It speaks generally and thoroughly. This is a great feature of Quran. Not only that Quran prohibits ancient unlawful and unnatural intercourse but Modern innovation too. Quran 23:5-7(see Part 1 of the Article for detail) clearly say that only lawful intercourse for a Muslim man is with his wife or slave and whoever goes beyond this limit is a transgressor. So all other kinds of intercourse i.e Fornication, adultery, Homosexuality, bestiality, necrophilia, or new inventions like sex toy, sex robots etc are forbidden according to these verses of Quran.

Claim: Right hand possess includes domestic animals:

Some christian missionaries accuse that “Right hand Possess” term in Quran include domestic animals. Since Quran allows intercourse with “what right hand possess” hence they claim that Quran allows bestiality. This is indeed very stupid and worst from Missionaries. Nowhere in Quran “Right hand possess” is used for other slaves. “Right hand Possess” is an idiom which only means slaves in the quran. Additionally, none of Muslim Scholars ever said that it may include non slaves.

Let see does “right hand possess” in Quran means other than slaves or it is stupid lie of Christian missionaries? Let me post the verses where “Right hand Possess” is used. Readers should think themselves that can it mean other than slaves.

Can an animal or a non human ask for permission at 3 times to enter home?

O you who have believed, let those whom your right hands possess and those who have not [yet] reached puberty among you ask permission of you [before entering] at three times: before the dawn prayer and when you put aside your clothing [for rest] at noon and after the night prayer. [These are] three times of privacy for you. There is no blame upon you nor upon them beyond these [periods], for they continually circulate among you – some of you, among others. Thus does Allah make clear to you the verses; and Allah is Knowing and Wise.

How an animal or any non human being can ask for eventual emancipation?

But let them who find not [the means for] marriage abstain [from sexual relations] until Allah enriches them from His bounty. And those who seek a contract [for eventual emancipation] from among whom your right hands possess – then make a contract with them if you know there is within them goodness and give them from the wealth of Allah which He has given you. And do not compel your slave girls to prostitution, if they desire chastity, to seek [thereby] the temporary interests of worldly life. And if someone should compel them, then indeed, Allah is [to them], after their compulsion, Forgiving and Merciful.

Mulim women are exempted from wearing Hijab in front of “right hand possess”. How can it be mean other female slaves?

Same rule is for wives of the Prophet SAWW

There is no blame upon women concerning their fathers or their sons or their brothers or their brothers’ sons or their sisters’ sons or their women or those their right hands possess. And fear Allah . Indeed Allah is ever, over all things, Witness.

A muslim man can have intercourse with married “right hand possess” women i.e captives.

Also (forbidden are) women already married, except those (captives and slaves) whom your right hands possess. Thus has Allah ordained for you. All others are lawful, provided you seek (them in marriage) with Mahr (bridal money given by the husband to his wife at the time of marriage) from your property, desiring chastity, not committing illegal sexual intercourse, so with those of whom you have enjoyed sexual relations, give them their Mahr as prescribed; but if after a Mahr is prescribed, you agree mutually (to give more), there is no sin on you. Surely, Allah is Ever All-Knowing, All-Wise.

It is legal to marry a “right hand possess” if she is believing.

And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess of believing slave girls. And Allah is most knowing about your faith. You [believers] are of one another. So marry them with the permission of their people and give them their due compensation according to what is acceptable. [They should be] chaste, neither [of] those who commit unlawful intercourse randomly nor those who take [secret] lovers. But once they are sheltered in marriage, if they should commit adultery, then for them is half the punishment for free [unmarried] women. This [allowance] is for him among you who fears sin, but to be patient is better for you. And Allah is Forgiving and Merciful.

How can an “Ahsan”(do good) be done on animals whom we eat or houses we possess?

Worship Allah and associate nothing with Him, and to parents do good, and to relatives, orphans, the needy, the near neighbor, the neighbor farther away, the companion at your side, the traveler, and those whom your right hands possess. Indeed, Allah does not like those who are self-deluding and boastful.

Do non humans have to do anything with wealth and properties?

And Allah has preferred some of you above others in wealth and properties. Then, those who are preferred will by no means hand over their wealth and properties to those (slaves) whom their right hands possess, so that they may be equal with them in respect thereof. Do they then deny the Favour of Allah?

With little different narration in

Other verses where permessibility to have intercourse with “right hand Possess” is given:,,

If Christian missionaries say that “right hand Possess” is used for other than slaves, they should give the reference of that verse .  Indeed “right hand Possess” in Quran only includes slaves and doesn’t include animals or non human as I proved.

Another ignorant claim of them is that Verse 14 of Chapter 3 in Quran defines right hand possess. Let me post the verse

Beautified for people is the love of that which they desire – of women and sons, heaped-up sums of gold and silver, fine branded horses, and cattle and tilled land. That is the enjoyment of worldly life, but Allah has with Him the best return.

Actually, this verse doesn’t define “right hand possession” or even “possession” at all. Read the verse. It is only defining desires of Men. In Islam, wives and children are not properties of men. It is not bible where it is legal to sold daughters for few shackles . It is not bible where if a girl is failed to prove her virginity on accusation of her husband will be stoned on her wedding night…. BTW this verse doesn’t define “right hand possession”. Period

Ayatollah Mosavi Khomeini:

Ayatollah Khomeini the founder of Shia Islamic Revolution is in controversy for his book “Tahrir Ul Wasilah”.  Anti-Islamists quoted his saying about “Bestiality” proving that Islam allowed Bestiality. Here I will prove how wrongly his sayings were misquoted.

Dr.Darabi Foundation, An organization run by an ex Shia Muslim , is working against Islamic revolution of Iran and criticize Islam(specifically Shia Islam)

Here is how she Quotes his sayings about Bestiality:

A man can have sex with animals such as sheep, cows, camels and so on. However he should kill the animal after he has his orgasm. He should not sell the meat to the people in his own village, however selling the meat to the next door village should be fine.

From Khomeini’s book, “Tahrirolvasyleh”, fourth volume, Darol Elm, Gom, Iran, 1990

“If one commits the act of sodomy with a cow, a ewe, or a camel, their urine and their excrement become impure, and even their milk may no longer be consumed. The animal must then be killed and as quickly as possible and burned.”

The little green book, Sayings of Ayatollah Khomeini, Political, Phylosophica, Social and Religious with a special introduction by Clive Irving

The Little Green Book:

Next here are quotes from “The Little Green Book” . It is another truth that this book is compiled and edited by Anti-Muslims to produce hate against Muslims but let us see how they quotes.

Reference: THE LITTLE GREEN BOOK>> Volume 2>> Part 9:On Urinating and Defecating

Online Source:

The meat of horses, mules, or donkeys is not recommended. It is strictly forbidden if the animal was sodomized while alive by a man.In that case, the animal must be taken outside the city and sold. If one commits an act of sodomy with a cow, a ewe, or a camel, their urine and their excrements become impure, and even their milk may no longer be consumed. The animal must then be killed as quickly as possible and burned, and the price of it paid to its owner by him who sodomized it.

Reference: The Little Green Book>> Volume :2 >> Part 9: On Ablution[ Body Purification ]

Online Text:

If a man – Allah protect him from it! – fornicates with an animal and ejaculates, ablution is necessary.

If a sperm moves inside the penis but does not come out, or if there is doubt about whether it actually was emitted, ablution is not required.

In Quote 1, one can clearly see “if a man has…..” rather than “A man can….”

See in quote 2 how he is quoted as saying “Allah protects a man from bestiality” clearly showing he considers it a sin.

Original Quotes:

“Tahrir Ul Wasilah” Volume 1 and Volume 2 are available online in English. Here are the Quotes which were deliberately misquoted.

Original Quote 1:

Reference: Tahrir Ul Wasilah>> Volume 1>> Part :b>> SECTION TWO – DEALING WITH CLEANLINESS (TAHARAT)>> Chapter on Najasat (the Unclean Objects) >> Page 52

Online Source:

Their Discussion, Rules, How they pollute and which of them are Excused

Problem #1: There are eleven unclean objects.

First & Second: The urine and excrement of an animal having a spurting blood whose meat is not eaten even if the prohibition is accidental, such as one eating unclean things or one with whom a man has committed bestiality.

My comment: Note here  he is only talking about Unclean objects. He is talking about Urine and milk of a cattle become unclean when it is sodomized by a man. He is not here saying whether a man is allowed in Islam to do so or not and if it there is a sin in it or not.

Original Quote 2:

Reference:  Tahrir Ul Wasilah>> Part: d>> SECTION FOUR – DEALING WITH FASTING (SOWM)>> Chapter on Things Which Must Be Refrained in a Fast>> Page 28

Online Source:

Problem # 2 The criterion is the application of the words eating and drinking, though they be in a way unusual. So if water reaches the cavity of his mouth through his nose, it shall be called drinking, though it is in an unusual way.

Third: Sexual Intercourse, whether the person subjected is a male or female, a human being or an animal, in the natural or unnatural way (i.e. from the front or the backside), whether the person subjected is alive or dead, a minor or an adult, whether the person committing the act is keeping fast or the one subjected, in all these cases the fast shall be deemed to be void, even if there has been no ejaculation. The fast is not rendered void if the act is done due to forgetfulness or coercion, depriving the person acting of control, excluding compulsion which also invalidates the fast. If a person indulges in a sexual intercourse out of forgetfulness or due to coercion, and during the act comes to realize (that it invalidates the fast), or the coercion is removed, he must withdraw immediately, so that if he delays the withdrawal, his fast shall be rendered void. If a person merely intended to rub his organ on the thighs, but the penetration has taken place unintentionally, then the fast shall not be rendered void. The same rule shall apply in case a person intends penetration, but it does not take place.

My comment:

Again, here he is only talking about fast whether bestiality voids fast or not and he says it does. He is not talking here whether Bestiality is a sin or not.

This is all what it was in Volume 1 and Volume 2. Volume 3 and Volume 4 are not yet available in these websites in english yet. They are available in Arabic though. But in another website, they’re availiable in english in Pdf form.

Problem #22. Among the causes rendering an originally lawful animal unlawful is the sexual intercourse of a man with it in the natural or unnatural way, even without the discharge of semen, regardless whether the performer of the intercourse is a minor or an adult, having knowledge of the illegality of the act or ignorant, having free will or being forced, the animal with which the act is done is male or female. So, according to the stronger opinion, the act renders its meat and the meat of its offspring born after the sexual act unlawful as regards the female offspring, and according to the more cautious opinion, even the male offspring. The same rule applies to their milk, fur or hair. Apparently the rule applies exclusively to the quadruped animals and it is not applied to other animals themselves or their offspring.

Problem #23 An animal with which sexual intercourse has been committed by a man, if it is one with which is meant for eating as a sheep or goat, a cow or she-camel, it is obligatory to slaughter it or then burn it, the preparator compensating its price to the owner if he is one other than its owner.

If, however, the animal belongs to the category meant for riding or loading and is not usually eaten like a donkey, a mule or a horse, it shall be carried away from the place where it was sexually abused and sold there, and its price shall be paid to the perpetrator of the act, paying its compensation to its master if the perpetrator was other than its master.

My Comments:

Once again one can see here that he is talking here about beef whether it is permissible to eat or sold or not when such act is done to the beast. He has not yet mention about penalty.

Now finally the last quote comes which is refutation to all the allegation and of course haters don’t quote it.

Original Quote 4:

Reference: Tahrir Ul Wasilah>> Volume: 2>> Section 47: Legal Punishment(Hudood)>> Chapter 7: Conclusion relating to other Punishments>> Part 2:Chapter on coition with animals(bestiality) and dead bodies

English Translation Source:

Problem #1. The Punishment for coition with animals is Ta’zir that depends on discretion of the judge. In it is a condition that culprit must be an adult, sane and having free will and without any doubt in case there is likelihood for it. So there is no Ta’zir for a minor boy even if he is discreet and whom the judge shall give chastisement according to what he deems advisable provided chastisement is effective in him.

So also there shall be no Ta’zir for a lunatic even if periodical when he commits the crime during the period of lunacy. Similarly, there shall be no Ta’zir for one acting under duress, or for one laboring under some doubt in case there is likelihood of doubt in his favour as regards the law and the matter.

Problem #2. This crime is established by the testimony of two witnesses of reputed integrity, but not by the testimony of women, alone or in combination with men. It is also established by the confession of the culprit if the animal[subjected to the act] belongs to him, otherwise there shall be liability for Ta’zir by his confession, but the law shall not apply to the animal[subjected to the act] except when it is confirmed by the owner.

Problem #3. If a person repeats the act, and there has been no intervening Ta’zir, he shall not be given any punishment other than Ta’zir, but if there has been an intervening Ta’zir, then according to the more cautious opinion, the culprit shall be condemned to death after he commits the act for the fourth time.

Last word:

Based on the last fatwa of Imam Khomeini, Iran is probably only country in the world that can legally execute a person on the crime of bestiality.  So, Iran is not only the most homophobic country in the world but it is also the most zoophile-phobic country of the world. Zoophiles from Europe should be very careful when they come to Iran for tourism.

Imam Nawawi’s exegesis:

Imam Nawawi was a great Shafi scholar and Muhaddith of Islam. People who accused Islam of condoning bestiality give reference of Imam Nawawi’s commentary on Sahih Muslim hadith 349. People even blame that it is words of the Prophet SAWW. Nevertheless, let see what Imam Nawawi was saying:

Following is the commentary of Imam Nawawi in Arabic.

Here is translation from a christian Missionary

In another narration the word ‘Ashu’biha’ is used. The scholars have disagreed about the intended meaning of ‘shu’biha Al-arba’ (the fours) for some said that it means the arms and the legs, while others have said that it refers to the legs and thighs, and other said it means the legs and the edge of the pubic area. Al-Qadi Ayad chose the meaning of the four areas surrounding the vagina. The word (Shu’b) means areas, its singular form being (Shu’bah). As for those who say (Ashba’iha) that is the plural of the word (Shu’b).
The word Aj-hada-ha (fatigue her) means to plow her, which was also stated by Al-Khatabi. Others have said it means to make her reach exhaustion as in the phrase ‘she made him toil and labor till he was exhausted’. Al-Qadi Ayad – may Allah rest his soul- said ‘Primarily, the word (Jahada’ha) means that the man exerted his effort working in a woman, where the word (Juh’d) means energy and refers to motion by describing the type of work. This is similar to his (the prophet) saying ‘he who plowed her’ meaning he who penetrated her by his motion. Otherwise, what other fatigue could a man experience because of her, and Allah knows best.
The meaning of the hadith is that the necessity to wash is not limited to when semen is ejaculated, rater it is when the penile head (Hash-fa, lit. “the head of the male member,” i.e. head of the penis) penetrates the vagina, then it is necessary for the man and the woman to wash. There is no disagreement on this today, even though there was disagreement on this by some of the early companions and others later. However, an agreement was later reached and this is what we have shown and presented previously.
Our companions have said that if the penile head has penetrated A WOMAN’S ANUS, or A MAN’S ANUS, or AN ANIMAL’S VAGINA or ITS ANUS then it is necessary to wash whether the one being penetrated is alive OR DEAD, YOUNG OR OLD, whether it was done intentionally or absentmindedly, whether it was done willfully or forcefully. This also applies if the woman places the male member inside her while the man is asleep, whether the penis is erect or not, whether the penis is circumcised or uncircumcised. All these situations require that the person committing the act and the one the act is committed on must wash themselves, unless the person committing the act or the person the act is committed on is a young male or female. In that case it cannot be said that the person must wash, for they do not have the responsibility, rather it is said that this person is in a state of impurity. If that person can discern (the sexual act) then his guardian can command him to wash just as he commands him to perform the ablution washing for prayers. For if he prays without washing, his prayer has not been performed correctly; likewise if he doesn’t wash after he reaches puberty he must be forced to wash. If he washed as a youth and then reaches puberty, then he does not have to repeat the washing.
Our companions have said that intercourse occurs when a healthy male’s penile head completely penetrates (an orifice), as has been unanimously agreed. Thus, when the penile head has completely disappeared (inside the orifice), then all the regulations concerning washing apply. It is unanimously agreed that it is not necessary that the entire penile shaft penetrate to apply the regulations of washing. If part of the penile head penetrates, then the regulations of washing are not imposed as is agreed, except by an odd few of our companions who said that even in this case all the regulations of washing apply. However, this opinion is wrong, rejected and abandoned. If the male member was severed and what remained was less than the length of the penile head, then none of the washing regulations apply. If the part remaining was equal in length to the penile head length then that part must completely penetrate for the regulation of washing to apply. If the part remaining was greater in length to the penile head length then there are two famous opinions for our companions. The most correct is that if the portion that penetrates is equal to the length of the penile head, then the regulations for washing apply. The other opinion is that none of the regulations for washing apply until the entire remaining length of the penile shaft completely penetrates and Allah knows best.
If a man wraps a sheath around his male member and then ejaculates inside a woman’s vagina, then there are three opinions from our companions. The most famous is that the man must wash. The second is that he does not have to wash because he ejaculated inside the sheath. The third is that if the sheath is thick and prevents climax and wetness (in the vagina) then washing is not necessary, otherwise it is necessary and Allah knows best.
If a woman inserts (in her vagina) AN ANIMAL’S PENIS she must wash, and if she inserts A DETACHED PENIS  there are two opinions; the most correct is that she must wash.

My Comments:

The first thing to notice that Imam Nawawi agrees that “Shuab Ul Arba” referring to parts of women’s body in paragraph 1 and 2. So he agrees that the hadith of The Prophet SAWW is talking only about sexual intercourse between man and his wife or Concubine.

In Paragraph 3, He writes that a man become impure after inserting his penis in another man, woman, animal, corpse, etc therefore he should bath. Same is the case with of a woman in last paragraph. It doesn’t mean that he thought Homosexuality, bestiality, necrophilia , rape etc are lawful in Islam. I don’t know how anti-Islamers especially Christian Missionaries are thinking that this exegesis means Islam allows bestiality and Necrophilia . Surely there is something wrong in their brains. They seriously need some psychiatric check up. Quran says about these people in 22:46

So have they not traveled through the earth and have hearts by which to reason and ears by which to hear? For indeed, it is not eyes that are blinded, but blinded are the hearts which are within the breasts

Here Imam Nawawi was only talking about Purification because the chapter was about Purification. He didn’t consider it necessary to mention how sinful Bestiality, Homosexuality and necrophilia are or what is punishment for such crimes. And what was his view about these acts, I have already mentioned in Part 2 of this article Part 2/3.
